Terms of Service

1. The Agreement

These Terms of Service ("Terms") are a legal agreement between you and FounderOSApp ("we," "us," or "our"). These Terms govern your access to the FounderOSApp website and our software (the "Service"). By creating an account, you confirm you are at least 18 years old and agree to these Terms.

2. Global Use & Governing Law

FounderOSApp is operated from Australia. These Terms are governed by the laws of New South Wales, Australia. For users based in the United States: You agree that any dispute resolution will be conducted only on an individual basis and not in a class action.

3. Subscription and Trial Flow

7-Day Free Trial

Access to the Service begins with a 7-day free trial.

  • End of Trial: Once the 7 days expire, your access to the software's tools and features will automatically cease.
  • Locked State: To regain functionality, you must "Opt-In" to a paid subscription. If you do not upgrade, your account will remain inactive, and you will never be automatically charged.

Payments & Renewals

Once you choose to upgrade to a paid plan, your subscription will automatically renew at the end of each billing cycle (monthly or annually). You authorize us to charge your stored payment method for these renewals.

No Refunds

Payments are non-refundable. If you cancel a paid subscription mid-cycle, you will have access until the end of that period, but no pro-rated refunds are issued.

4. User Rights and Data

You retain full ownership of the data and content you input into FounderOSApp. We do not claim any ownership rights over your work. The FounderOSApp software and brand remain our exclusive property.

5. Prohibited Conduct

You agree not to:

  • Resell or sub-license access to your account.
  • Use automated tools (bots/crawlers) to scrape data.
  • Attempt to reverse engineer or copy the software code.

6. Service Levels and Liability

"As-Is" Service

We provide the Service on an "as-is" basis. While we strive for 99.9% uptime, we do not guarantee uninterrupted service.

Australian Consumer Law (ACL)

Nothing in these Terms excludes or limits any guarantees or rights you may have under the Competition and Consumer Act 2010 (Cth) which cannot be excluded.

Limitation of Liability

To the maximum extent permitted by law, FounderOSApp's total liability shall be limited to the amount you paid us in the 12 months preceding the event.

7. Account Termination

We may suspend or terminate your account if you breach these Terms. It is your responsibility to export your data or upgrade your plan before the trial ends to avoid losing access to your inputs.

8. Updates to These Terms

We may update these Terms to reflect changes in the law or our Service. We will notify you of material changes via email or an in-app notification.
